The policy forms cover only owned or rented equipment, not donated
equipment. We suggest that the equipment owner and production company draw
up a simple rental agreement, which could take the form of the following:
"For the sum of $1.00, John Doe agrees to
rent my camera/sound/lighting equipment to XYZ Productions, Inc., for the
term January 1, 2019 through January 20, 2019. XYZ Productions agrees to
provide replacement cost insurance in the amount of $350,000 for the full
term of the rental, naming John Doe as a Loss Payee. In addition, XYZ
Productions will name John Doe as an Additional Insured on its General
Liability and Non-Owned Auto Liability policy for the full term of the
rental." |
